A judge is insisting on jail time for a Westville man accused of driving

on a suspended license while drunk.

La Porte Circuit Court Judge Tom Alevizos on Wednesday expressed outrage

that a plea agreement does not call for any time behind bars.

43 year old Jeffrey Mitchell racked up three prior drunk driving convictions

and his license was suspended for 10-years when pulled over for speeding in June.

The plea agreement called for a two year sentence on work release and one year on

probation.

In rejecting the plea....Alevizos said he didn't care if Mitchell lost his job

from having to go to jail....but felt some time behind bars was needed.

Prosecutors and the defense will now attempt to come up with another plea

more to the judge's liking or take the case to trial.

Another hearing in the case was set for November 21.
