60-years for murder

A 60 year prison sentence was given today to a Michigan City man for fatally shooting

his girlfriend.

24 year old Brian Taylor was convicted six weeks ago....after his first trial in March ended with

a hung jury.

After sentencing....defense attorney David Payne asked LaPorte Circuit Court Judge

Tom Alevizos to overturn the second jury's verdict.

Payne said who pulled the trigger and how it happened was never proven.....

The judge said he could see where a jury might struggle with its decision but felt the

evidence was not lacking enough to overturn the verdict.

Close to four years ago.....24 year old Simone Bush died from a gunshot to the neck.

According to prosecutors...she was getting ready for work on Michigan City's west side

when Taylor became angry she would not give him sex......and refused to give her a ride.

Prosecutors also say there was evidence the woman was cornered against a bedroom wall

with a gun to her neck when shot.

But...the defense said the gun was actually owned by the victim..and Taylor had injuries

to indicate there was a struggle.'

Some of the evidence could not be shown to the jury.

It was thrown out by the Indiana Supreme Court because of investigators eavesdropping on

a privileged conservation between the defendant and his attorney.
