A Michigan City man handed a 55-year prison sentence is appealing his conviction for killing his girlfriend's lover.

Joshua Ratliff, 23, was found guilty of murder June 7 by a LaPorte Superior Court 1 jury.

Brian Turner was shot 10 times, authorities said.

The evidence showed Ratliff after finding out about the relationship in November ordered his live-in girlfriend to bring the 22-year old Turner also from Michigan City to the couple's upstairs apartment at 615 Spring St.

The defense argued Ratliff only wanted to fight Turner but shot him after Turner fired the first shot.

Ratliff kept shooting out of fear Turner might harm his four children sleeping in a bedroom the victim ran toward after first shot, according to the defense.

Prosecutors said Turner could not have fired first judging by the location of the one bullet hole he created and location of his shell casing.

According to court records, a public defender was appointed following his July 17 sentencing to represent Ratliff in his appeal.
