guilty of dealing heroin

They came to LaPorte from outside the area selling drugs like heroin in parking lots.

That was the evidence presented to a jury who took less than one-hour to find Ricky Kinds, 41, of South Bend guilty of level 4 felony dealing in a narcotic drug.

His conviction was for the sale of heroin June 9 to a confidential informant while under surveillance.

Marylynn Patton, 30, is already serving an eight-year prison sentence after pleading guilty in February to selling cocaine and heroin.

Kinds, who's confined to a wheelchair, could receive anywhere from a 2 to 12-year sentence.

LaPorte County Drug Task Force commander Sgt. Andy Hynek described the pair as mid-level dealers partnering with a few others from the South Bend area to distribute narcotics.

He said the arrests happened during a six week period when several other suspected dealers from the east and west got caught selling here.

According to the testimony, the sale was conducted from a van occupied by Kinds, Patton and her two children, ages 3 & 10, outside Speedway along Indiana 2 on the city's east side.

During her testimony, Patton denied Kinds had any involvement in the sale.

However, LaPorte County deputy prosecutor Julianne Havens presented evidence that showed Kinds was the confidential informant's main supplier and the relationship between Kinds and Patton was strictly tied to drugs.

''The informant said he could buy drugs from Ricky and Mary and he did,'' Havens said.

She said Patton simply didn't want to snitch on Kinds out of fear of retaliation by members of their ring.

Defense attorney Larry Rogers of Valparaiso said the police investigation not thorough enough had too many holes to convict his client.

Hynek said Patton sometimes came here by herself with drugs given to her by Kinds to sell.

Occasionally, they showed up together.
