Police in LaPorte let a drunk driver go before he killed two people out in the county

last year.

Those are the allegations in legal action filed on behalf of the victim's family.

Don and Angie Kaczmarek owned Packman's Pizza in downtown LaPorte.

They were on delivery when killed from being struck head on near Rolling Prairie in October.

The driver....Tron Gorbonosenko.....was seriously hurt and now is facing charges.

He was a paramedic with LaPorte County Emergency Medical Service at the time.

According the legal action......he crashed into a parked car and telephone pole

In the area of Lincolnway and J street.

Witnesses claim he staggered out of the car...and suspected he was intoxicated.

The legal action alleges three police officers never gave him a breath test or

even asked for his driver's license.

And allowed him to drive off......

90 minutes later....the Kaczmarek's were killed on U.S 20 by Gorbonosenko who allegedly

had a blood alcohol level over two times the legal limit.

The legal action is seeking 700 thousand dollars.

LaPorte Police Chief Tom Owens said he had not received a copy of the legal action

Therefore....he could not comment.....
